Who we are and what these terms cover
These Terms of Service ("Terms") are an agreement between you and CONSUL INTERNATIONAL 1991 SH.P.K., trading as CastPDF, of Taulantia Str. 1, 2001 Durrës, Albania ("CastPDF", "we", "us"). They apply to the website at https://castpdf.com, the dashboard at https://app.castpdf.com and the API at https://api.castpdf.com (together, the "Service").
If you use the Service for an organisation, you accept these Terms on its behalf and confirm that you may do so; "you" then means that organisation. The Service is made for businesses and developers. If you are a consumer, the mandatory consumer protection law of the country you live in still applies, and nothing in these Terms limits it.
These Terms include, by reference, our Acceptable Use Policy, Refund Policy and Privacy Policy, and, where we process personal data for you, the Data Processing Agreement. By creating an account or using the Service you accept them.
The Service
CastPDF generates PDF documents from HTML templates and JSON data, through an HTTP API and a web dashboard. What the Service does, and its limits, are described in the documentation. We improve the Service over time and may change or remove features. We will not materially reduce the features of a paid plan during a billing period you have already paid for.
Your account
- You need an account to use the dashboard and the API. You must be at least 18 years old and give us accurate information, including a working email address. Live API keys require a verified email address.
- Keep your password and API keys secret. You are responsible for what happens under your account and with your keys, including usage that is billed. If you think a key or your account has been compromised, revoke the key in the dashboard and tell us at [email protected].
- One person or organisation per account. Do not create several accounts to get around plan limits.
API keys, test keys and fair use
- Live keys generate documents that count towards your plan. On the Free plan, live documents (including those made with the dashboard's Generate PDF button) carry a small "Made with CastPDF · castpdf.com" footer with a link to castpdf.com on every page; paid plans do not. Test keys are free: their documents carry a "CASTPDF TEST" watermark, are not counted, and are limited to 20 requests a minute. Test keys are for development and testing only.
- Each plan has a rate limit for live keys, listed in the documentation, and each document has technical limits (for example 50 pages and a 30-second render time).
- Use the Service at a reasonable pace. We may slow down or refuse requests that put the Service or other customers at risk, and we will tell you if a pattern of use needs to change.
Acceptable use
You must follow the Acceptable Use Policy. In short: nothing illegal, no phishing, impersonation, malware or spam, and no attempts to get around limits or to reach networks through our renderer.
Export controls and sanctions
You may not use the Service if you are located or ordinarily resident in a country or region under a comprehensive embargo or sanctions program of the United Nations, the European Union, the United Kingdom, the United States or Albania. You may not use it if you are on a sanctions list of any of them, or owned or controlled by someone who is. You may not use the Service in breach of export control or sanctions laws. We may suspend or close an account that we reasonably believe breaks this section. Paddle may also refuse a purchase for these reasons.
Plans, fees and billing
- Plans and prices are on the pricing page. Prices are in US dollars and exclude tax. The Free plan costs nothing and needs no payment details.
- Paddle is our Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle processes the payment, calculates and collects sales tax or VAT, issues the invoice, and handles refunds and payment disputes. When you buy a subscription, Paddle's buyer terms apply to the purchase, alongside these Terms.
- Subscriptions renew automatically, monthly or annually, until you cancel. Annual billing costs ten times the monthly price. On annual plans your included documents are still counted per monthly period.
- What counts: one successful document generated with a live key or with the dashboard's Generate PDF button is one document, whatever its page count. Failed requests, test-key documents and previews are not counted.
- Rollover: on paid plans, included documents you did not use in one monthly period carry over to the next period only. They are used first, expire at the end of that period, and are capped at the next period's plan quota. The Free plan has no rollover, and moving to the Free plan ends it.
- Overage: on paid plans, once your included documents (rollover included) are used, documents are billed as overage at your plan's price per 1,000 documents shown on the pricing page, charged per document and rounded up to the next cent per billing period. Overage is billed through Paddle after the period ends; a period's overage under $1 is not billed.
- Spending cap: every paid plan has a cap on the overage cost of a period. It starts at twice your plan's monthly price and you can change it in the dashboard, up to $10,000. Requests that would exceed the cap are refused (
spending_cap_reached) until you raise the cap, upgrade or the next period starts. - When overage is not available: on the Free plan, while a cancellation is scheduled, while a payment is overdue, or without an active subscription. Live requests beyond your included documents are then refused.
- Plan changes: upgrades take effect at once, and Paddle charges the prorated difference. Downgrades take effect at the next renewal.
- Cancellation: you can cancel at any time from the billing page of the dashboard. The cancellation takes effect at the end of the period you have paid for; until then your plan keeps working, and afterwards your workspace moves to the Free plan. Your templates are kept. Overage used in the current period before a scheduled cancellation is billed before the subscription ends.
- Failed payments: Paddle retries the payment. For a grace period of 7 days your plan's included documents keep working while you update your payment method, and overage is paused. If the payment is still outstanding after that, your workspace moves to the Free plan.
- Price changes: a price increase applies to your subscription only from your first renewal after at least 30 days' notice by email. See Notice of changes and closure.
Refunds
You can request a refund within 14 days of a subscription payment, including prorated upgrade charges, unless more than 20% of the documents included in that period have been used. Overage (usage) charges are refunded only when they result from a billing error. There are no pro-rata refunds: after the 14-day window, fees already paid are not refunded, in whole or in part, in any case. The details, including how overage charges are handled, are in the Refund Policy.
Notice of changes and closure
We give you at least 30 days' notice by email before:
- a price increase applies to your subscription;
- a change to the Terms that is materially to your disadvantage takes effect;
- we close the Service.
You may cancel before the change takes effect. Your subscription then ends at the end of the period you have already paid for. Fees already paid are not refunded. If we close the Service, billing continues normally until the closure date, and no renewal is charged for a period that would start after the closure date.
Availability and support
We work to keep the Service available and fast, and we fix problems as quickly as we reasonably can. There may be interruptions, including planned maintenance, which we try to schedule at quiet times.
The Service is provided without a service level agreement: we do not commit to a specific availability percentage and no service credits apply.
Support is by email at [email protected].
Beta and preview features
We may offer features labelled beta, preview or early access. They are provided "as is", may change or end at any time, and no availability commitment or service credits apply to them. Using them is optional.
Your content
- You own your content: your templates, the data you send, and the PDFs the Service generates from them ("Your Content"). We claim no ownership of it.
- You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, render and transmit Your Content only to provide, maintain and secure the Service for you, as the Privacy Policy and the Data Processing Agreement describe. The licence ends when Your Content is deleted from our systems, as described in the Privacy Policy's retention section.
- You are responsible for Your Content: that you have the rights to it, that it is lawful, and that the documents you generate meet the requirements that apply to them (for example the legal requirements for invoices in your country). We do not check the content of your documents.
- Where Your Content contains personal data, you are the controller and we process it on your behalf under the Data Processing Agreement.
We do not sell Your Content, do not use it for advertising, and do not use it to train AI models.
Our intellectual property
The Service, its software, documentation and the CastPDF name and logo belong to us or our licensors. While your account is active, we give you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You may not copy, modify or reverse engineer the Service, except where the law allows it despite this restriction. If you send us feedback or ideas, we may use them without obligation to you.
Confidentiality
Each of us may receive information from the other that is not public, such as your account and usage details, or our non-public technical and business information. Each of us keeps the other's non-public information confidential, uses it only for these Terms, and shares it only with people who need it for that and are bound to keep it confidential, or when the law requires it. This does not apply to information that is or becomes public without the receiving party's fault, that the receiving party already had or develops on its own, or that it lawfully receives from someone else. Your Content and personal data stay covered by the Privacy Policy and the Data Processing Agreement, which protect them as described there.
Suspension and termination
- By you: you can stop using the Service at any time. Cancel any paid subscription from the dashboard, and ask us by email to delete your account, at [email protected]; we do so within 30 days.
- By us: we may suspend or restrict your account, or revoke API keys, if you seriously or repeatedly breach these Terms or the Acceptable Use Policy, if your use creates a security or legal risk for us or others, if a payment is not made, or if the law requires it. We will tell you why and, where it is reasonable, give you a chance to fix the problem first. We may end these Terms at once for a serious breach. If we suspend or end your account because you breached these Terms or the Acceptable Use Policy, fees already paid are not refunded. We may also end these Terms without cause by giving you at least 30 days' notice. No further renewal is charged after that notice, and fees already paid are not refunded. If we close the Service, Notice of changes and closure applies.
- Afterwards: access to the Service ends. Your content is deleted as described in the Privacy Policy. Before your account ends, download any templates and documents you want to keep; the API gives you access to them.
- The sections on your content, confidentiality, fees owed, warranties, liability and governing law continue to apply after termination.
Warranties and disclaimers
We provide the Service with reasonable skill and care. Apart from that, and to the extent the law allows, the Service is provided "as is" and "as available", without other warranties, express or implied, including fitness for a particular purpose. In particular, we do not promise that the Service will be uninterrupted or error-free, or that the PDFs it generates meet any legal, tax or accessibility standard: check the documents you generate before you rely on them.
Limitation of liability
- Neither party is liable for indirect or consequential loss, or for loss of profits, revenue, business, goodwill or anticipated savings, whether or not it was foreseeable.
- Each party's total liability arising out of or in connection with these Terms, in any 12-month period, is limited to the fees you paid for the Service (through Paddle) in the 12 months before the event giving rise to the claim.
- Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for your obligation to pay fees, or for anything else that cannot be limited or excluded by law.
- You will compensate us for reasonable costs and losses arising from third-party claims caused by Your Content or by your breach of the Acceptable Use Policy.
Changes to these Terms
We may update these Terms. For a material change we will email the account owner at least 30 days before it takes effect, and we update the "Last updated" date above. If you do not agree, you can cancel before the change takes effect; continuing to use the Service afterwards means you accept it. If you cancel, your subscription ends at the end of the period you have already paid for, and fees already paid are not refunded. Changes required by law or made for security reasons may take effect sooner.
Governing law and disputes
These Terms are governed by the laws of the Republic of Albania. Any dispute arising out of them is subject to the jurisdiction of the competent courts of Durrës, Albania. If you are a consumer, you may also bring a claim in the courts of the country where you live, and the mandatory law of that country continues to protect you. Before going to court, please contact us: most problems can be solved by email.
General
- These Terms, the policies they refer to and the Data Processing Agreement are the whole agreement between us about the Service. If a provision is found invalid, the rest remains in force.
- You may not transfer these Terms without our written consent. We may transfer them to a successor of our business, and will tell you if we do.
- Not enforcing a right is not a waiver of it.
- Neither party is liable for delays or failures caused by events outside its reasonable control.
- We send notices to the email address of your account. Send legal notices to us at [email protected].
